ORDINANCE NO. 13
"AN ORDINANCE DECLARING UNLAWFUL OR ILLEGAL THE PRACTICE OF THE "BUAYA SYSTEM" IN ALL TRANSPORTATION BUSINESS WHETHER LAND, WATER OR AIR AND PROHIBITING RESPECTIVE OPERATORS TO MAKE AND MAINTAIN THE SAME AND IMPOSING PENALTIES FOR VIOLATION THEREOF"
BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN, THAT:
SECTION 1. Definition of "Buaya System" - the buaya system is a practice by which a person for some pecuniary interest, without any permit/license, solicit passengers and/or cargoes for any transportation business.
SECTION 2. It shall be unlawful and illegal for any person to solicit passengers and/or cargoes for any transportation business as defined under Section 1 hereof, without any permit and/or license from the Office of the Municipal Mayor.
SECTION 3. Dispatcher may be allowed for any transportation business whether water, land or air provided that they secure from the Office of the Mayor the necessary permit and/or license for their being dispatchers, and provided further that they present to the Office of the Mayor a written authority or appointment as such dispatcher, from the transportation business or company.
SECTION 4. Any dispatcher granted permit by the Mayor or his duly authorized representative shall pay a fee of Sixty (P60.00) Pesos per annum.
SECTION 5. Only two (2) dispatchers may be allowed for every transportation business or company.
SECTION 6. Any dispatcher is strictly prohibited from issuing transportation tickets except in the office of the company or on board the transportation.
SECTION 7. Any person convicted by the Court for violation of any of the provision of this Ordinance shall be punished by a fine of not less than Twenty (P20.00) Pesos nor more than Fifty (P50.00) Pesos or by an imprisonment of not more than twenty-five (25) days or both such fine and imprisonment in the discretion of the Court.
SECTION 8. This Ordinance amends Ordinance No. 5, series of 1961, No. 9, series of 1962, and No. 44, series of 1967, and all other ordinances preceding this Ordinance, should any of their provision be inconsistent with this Ordinance.
SECTION 9. This ordinance shall take effect immediately upon approval.
