ORDINANCE NO. 44


"AN ORDINANCE DECLARING UNLAWFUL OR ILLEGAL THE PRACTICE OF THE "BUAYA SYSTEM" IN ALL TRANSPORTATION BUSINESS WHETHER LAND, WATER OR AIR PROHIBITING RESPECTIVE OPERATORS TO MAKE AND MAINTAIN THE SAME AND IMPOSING PENALTY FOR VIOLATION THEREOF"


	BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN, THAT:

	SECTION 1. Definition of "Buaya System" - the buaya system is a practice by which a person for some pecuniary interest, without any permit/license, solicit passengers and/or cargoes for any transportation business.

	SECTION 2.	 It shall be unlawful and illegal for any person to solicit passengers and/or cargoes for any transportation business as defined under Section 1 hereof, without any permit and/or license from the Office of the Municipal Mayor.

	SECTION 3.	Every transportation operator doing business within the Municipality of Pagadian, shall submit to the Office of the Mayor the names of his respective drivers, conductors and dispatchers.

	SECTION 4.	 Dispatcher may be allowed for passenger buses only provided that they secure from the Office of the Mayor the necessary permit and/or license for their being dispatchers, and provided further that they present to the Office of the Mayor a written authority or appointment as such dispatcher, from the bus operator.

	SECTION 5.	No dispatcher or "Buaya" is allowed or permitted to operate within the premises of the wharf or port area.

	SECTION 6.	No person shall be permitted to act as dispatcher or "buaya" for water and air transportation. Consequently, any person acting as dispatcher or "buaya" for air and/or water transportations shall be liable to the penalties imposed by this Ordinance.

	SECTION 7.	Bus dispatchers are strictly prohibited to hire or employ assistants or helpers.

	SECTION 8.	 Any person convicted for violation of any of the provision of this Ordinance shall be punished by a fine of not more than Fifty (P50.00) Pesos nor less than Twenty (P20.00) Pesos or suffer an imprisonment of not more than twenty-five (25) days or both such fine and imprisonment in the discretion of the Court.

	SECTION 9.	This Ordinance amends Ordinance No. 5, series of 1961 and all other ordinances preceding this Ordinance, should any of their provision is inconsistent to this Ordinance.


      SECTION 10.This ordinance shall take effect immediately upon approval.
