ORDINANCE NO. 26
"AN ORDINANCE PROHIBITING ANY ELECTED OFFICIAL OF THE MUNICIPALITY OF PAGADIAN OR OF THE PROVINCE OF ZAMBOANGA DEL SUR, FROM ENGAGING, ACCEPTING OR BEING ENGAGED AS A RETAINER OF ANY PERSON, FIRM, ASSOCIATION, OR CORPORATION, WHERE THE DUTIES OF SUCH OFFICIAL WILL DIRECTLY OR INDIRECTLY INFLUENCE OR TEND TO INFLUENCE THE RESULT OF A CASE INVOLVING THE INTEREST OR WELFARE OF THE MUNICIPALITY OF PAGADIAN, AND/OR FROM BEING WITNESS IN A CASE WHEREIN THE INTERESTS AND WELFARE OF THE MUNICIPALITY OF PAGADIAN IS INVOLVED, AND IMPOSING PENALTIES FOR VIOLATION THEREOF"
BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN, THAT:
SECTION 1. Any elected official of the Municipality of Pagadian or of the Province of Zamboanga del Sur, is strictly prohibited from:
a) engaging, accepting or being engaged as a retainer of any person, firm, association, or corporation, where the duties of such official will directly or indirectly influence or tend to influence the result of a case involving the interest or welfare of the Municipality of Pagadian;
b) being a witness in a case wherein the interests and welfare of the Municipality of Pagadian is involved.
SECTION 2. Any elected official of the Municipality of Pagadian or of the Province of Zamboanga del Sur, convicted by the Court for violation of Section 1 hereof, shall be punished to pay a fine of not less than One Hundred (P100.00) Pesos nor more than Two Hundred (P200.00) Pesos and to suffer an imprisonment of not less than two (2) months nor more than six (6) months at the discretion of the Court.
SECTION 3. This ordinance shall take effect upon approval.
