AN ORDINANCE PRESCRIBING PENALTIES FOR THE CRIME OF VAGRANCY AND/OR PROSTITUTION

ORDINANCE NO. 7


"AN ORDINANCE PRESCRIBING PENALTIES FOR THE CRIME OF VAGRANCY AND/OR PROSTITUTION"

	BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN, THAT:

	SECTION 1. The following are vagrants:

	a. Any person having no apparent means of subsistence, who have the physical ability to work and who neglected to apply himself or herself to some lawful calling.

	b. Any person found loitering about public or semi-public buildings or places or tramples or wandering around the municipality or the streets without visible means to support.

	c. Any idle or dissolute person who ledges in houses or ill-fame; ruffians or pimps and those who habitually associate with prostitutes.

	d. Any person who shall be found loitering in any inhabited or uninhabited place belonging to another without any lawful or justifiable purposes.

      SECTION 2.	Prostitute - For purposes of this ordinance, a prostitute is any woman who, for money or profit, habitually indulges in sexual intercourse or lascivious conduct.


      SECTION 3. It shall be unlawful and prohibited for any person to be or to commit the act of, vagrant or prostitute.


      SECTION 4. Any person convicted of the crime of vagrancy or prostitution by the Court shall pay a fine of not less than Fifty (P50.00) Pesos nor more than One Hundred (P100.00) Pesos or suffer an imprisonment of not less than Two (2) months nor more than Six (6) months or both such fine and imprisonment in the discretion of the Court. In case of insolvency, a subsidiary imprisonment shall be imposed.


      SECTION 5. This ordinance shall take effect immediately upon approval.
