ORDINANCE NO. 32


"AN ORDINANCE AMENDING ORDINANCE NO. 14, SERIES OF 1964, PROHIBITING DRIVERS AND CONDUCTORS FROM ACCEPTING MORE PASSENGERS OR MORE CARGOES OR FREIGHTS IN HIS MOTOR VEHICLE THAN ITS REGISTERED CARRYING CAPACITY, THE RIDING ON RUNNING OR STEP BOARDS OR ON THE COVER OR TOP OF THE TRUCK OR VEHICLE AND IMPOSING PENALTY THEREOF"

	BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN, THAT:

	SECTION 1. No person operating a motor vehicle shall allow more passengers or more freight or cargo in his motor vehicle than its registered carrying capacity.

	SECTION 2.	No truck shall be allowed to carry passengers or any person on the cover or top of the same, provided, however, that if permits are granted by the Director of Public Works or Deputies baggage or freight may be so carried not to exceed twenty (20) kilos per square meter distributed so that it will not endanger the passenger or stability of the truck.

	SECTION 3.	No operator shall permit any person or persons to ride on the running boards, step boards, or mudguards, or cover to the engine, for any purpose, except for necessary adjustment of the motor or mechanism, or for collection of fares by the conductor of a public passenger motor vehicle. In no case shall such conductor remain on the running boards while not actually making collections.

	SECTION 4.	In the case of passenger trucks, buses and jeepneys, the conductor shall be responsible exclusively for violation of Sections 1, 2 & 3 hereof: provided, however, that in case there is no conductor of said vehicle but the driver is at the same time the conductor, the said driver shall be responsible therefore. In the case of cargo trucks and other non-passenger vehicles, the driver shall be responsible under said Sections 1, 2 & 3 hereof.

	SECTION 5.	The penalty under Section 1 of this Ordinance shall be a fine of Two (P2.00) Pesos for every excess passenger or subsidiary imprisonment in case of insolvency, and under Sections 2 & 3, a fine of not less than Thirty (P30.00) Pesos nor more than One Hundred (P100.00) Pesos or suffer an imprisonment of not less than thirty (30) days nor more than six (6) months, or both such fine and imprisonment in the discretion of the Court. In case of insolvency of the driver and/or conductor to pay the fine, the operator will be held liable.
