ORDINANCE NO. 21
"AN ORDINANCE DECLARING AS NUISANCE, AND ORDERING THE REMOVAL AND/OR DEMOLITION OF, ALL UNSIGHTLY AND/OR NIPA SHACKS OR SHELTERS OR TEMPORARY CONSTRUCTION ALONG THE COMMERCIAL STREETS OF PAGADIAN WITHIN THE COMMERCIAL ZONE AND PRESCRIBING PENALTIES FOR VIOLATION THEREOF"
BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT:
SECTION 1. All unsightly and/or nipa shacks or shelters or temporary constructions, particularly those used by fruits and peanuts vendors near New Theater, are hereby declared as nuisance.
SECTION 2. All owners of unsightly and/or nipa shacks or shelters or temporary constructions mentioned in Section 1, hereof, shall remove or demolish them at their own expense immediately upon notice by the Police of Pagadian.
SECTION 3. Any owner mentioned in Section 2, hereof, found violating the provision of Section 2 of this Ordinance, shall upon conviction be punished by a fine of not less than Ten (P10.00) Pesos nor more than Thirty (P30.00) Pesos and by an imprisonment of not less than Ten (10) days nor more than Thirty (30) days or both such fine and imprisonment at the discretion of the Court. In addition to the penalties of fine and imprisonment imposed hereof, the violators shall be ordered to demolish or remove his structure or shack at his own expense or the same structure shall be demolished or removed by the Police upon order of the Court at the expense of the violator.
SECTION 4. This Ordinance shall take effect on December 4, 1963.
