ORDINANCE NO. 2
"AN ORDINANCE PRESCRIBING RULES AND REGULATIONS AND SPECIFICATIONS IN THE DEVELOPMENT OF SANTA LUCIA PUBLIC MARKET SITE AND IN THE CONSTRUCTION OF SIDE STORES THEREAT AND IMPOSING PENALTIES FOR VIOLATION THEREOF"
BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT:
SECTION 1. All side stores along Mabini Street and Santa Lucia road shall be constructed ten (10) meters from the edge of the road.
SECTION 2. The reclamation expenses for the area co-extensive with the side store be borne by the awardee or owner of the store.
SECTION 3. Each side stores shall have the following dimensions: 4 and � meters wide fronting the road and 7 meters long.
SECTION 4. The wall of the side store shall be made of hollow blocks and the roof, of galvanized iron sheets with one sheet of skylight. The posts shall be 14 feet in height.
SECTION 5. All side stores shall be only one storey without mezzanine.
SECTION 6. An exit road or alley of six (6) meters wide shall be constructed at the center of every block.
SECTION 7. No side stores awardee or owner shall established therein medical or dental clinic, pharmacy, and barber shop, except those medical or dental clinic, pharmacy, and barber shop that where established prior to or were existing before the conflagration of April 24, 1962, provided, however that no hotel shall be established within the premises of the Santa Lucia Market site.
SECTION 8. The construction of side stores shall be subject to the specifications of the Municipal Council of Pagadian.
SECTION 9. The monthly rental for every side store with the dimension of 4 and � meters by 7 meters shall be as follows:
a. Each side store along Mabini Street
and Santa Lucia Street P15.00
SECTION 10. Any person convicted for violation of this Ordinance by the Court shall pay a fine of not less than Thirty (P30.00) Pesos nor more than Two Hundred (P200.00) Pesos or suffer an imprisonment of not less than One (1) month nor more than five (5) months, or both such fine and imprisonment in the discretion of the Court.
SECTION 11. Any ordinance or part thereof inconsistent with this Ordinance is hereby modified or repealed.
SECTION 12. This Ordinance shall take effect immediately upon approval.
