ORDINANCE NO. 13


"AN ORDINANCE PRESCRIBING THE FIRE HAZARD ZONE IN THE POBLACION OF PAGADIAN AND PRESCRIBING RULES AND REGULATIONS ON FIRE PREVENTION AND IMPOSING PENALTIES FOR VIOLATION THEREOF"

      BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT:

	SECTION 1. The area with the following boundaries within the Poblacion of Pagadian is hereby established and declared as fire hazard zone:


FIRE HAZARD ZONE

	NORTH		CEFERINO DE LEON STREET
	SOUTH		THE SEA
	EAST		F. DE ROXAS STREET
	WEST		CAPITOL ROAD
	Both sides of the National Highway from Balangasan to PC area.

	SECTION 2.	Within the fire hazard zone established in Section 1 hereof, no person is allowed to repair, remodel, or construct a house of light material. All repair, remodel or construction of buildings shall be of at least mixed materials with galvanized iron roof.

	SECTION 3.	No store, business firm or business establishment shall store or keep within the fire hazard zone any inflammable or combustible materials in excess of the following quantity regardless of brand:
	(a) Kerosene		10 cans of 10 liters
	(b) Gasoline or crude oil		1 drum
	� Other derivative products of crude
	petroleum		1 drum
	(d) Fire crackers		1 cartoon
	(e) Matches		1 cartoon
	(f) Any other explosive powder or
	inflammable liquid		1 drum or 1 cartoon

	SECTION 4.	Any quantity in excess of the allowed quantity of inflammable or combustible materials as provided for in Section 3 hereof, shall be stored in fire proof materials warehouse building constructed outside the fire hazard zone.

	SECTION 5.	It shall be unlawful for any person to hinder or stop any person authorized by the Municipal Mayor or the Chief of Police of this Municipality, from entering and inspecting the store, business firm or establishment in connection with the enforcement of this Ordinance.

	SECTION 6.	Any ordinance or part thereof inconsistent with this Ordinance in toto in parte, is hereby amended or repealed.

	SECTION 7.	Any person convicted for violation of this Ordinance for every offense, shall pay a fine of not less than Fifty (P50.00) Pesos nor more than Two Hundred (P200.00) Pesos or suffer an imprisonment of not less than One (1) month, nor more than Six (6) months, or both such fine and imprisonment in the discretion of the Court. Any combustible or inflammable materials found in the store or business firm or establishment in violation of Section 3 and 4 shall be confiscated in favor of the Municipality of Pagadian.

	SECTION 8. This Ordinance shall effect immediately upon approval.
