ORDINANCE NO. 1


"AN ORDINANCE PROHIBITING PRIVATE PERSONS FROM UTILIZING SIDE-WALK DISPLAY OF MERCHANDISE OR FOR BUILDING CONSTRUCTION, DECLARING ALL CONSTRUCTIONS OBSTRUCTING THE SIDE-WALK AS NUISANCE AND IMPOSING PENALTIES FOR VIOLATION THEREOF"

	BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN, THAT:

	SECTION 1. It is unlawful for any private person to utilize the side-walk either for display of merchandise or for building construction.

	SECTION 2. All construction obstructing the side-walk is considered and declared a nuisance.

	SECTION 3. A thirty (30) day period from the date of notice shall be given to the person concerned to demolish or clear the obstruction made by him from the side-walk and after this thirty-day period, the Municipal Government shall cause the demolition or clearance of the said obstruction at the expense of the owner.

	SECTION 4.	Any person found violating any of the provisions of this Ordinance shall, upon conviction, pay a fine of not less than Fifty (P50.00) Pesos or more than One Hundred (P100.00) Pesos or suffer an imprisonment at the discretion of the Court.

	SECTION 5.	This Ordinance shall take effect immediately upon its approval.
