ORDINANCE NO. 12
"AN ORDINANCE PROHIBITING THE SALE OF ALCOHOLIC LIQUOR AND/OR BEVERAGES WITHIN THE MUNICIPALITY OF PAGAIN AFTER TEN O'CLOCK IN THE EVENING, AND IMPOSING PENALTY FOR VIOLATION THEREOF"
BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN, THAT:
SECTION 1. It shall be unlawful for any person or persons to sell to anyone within the Municipality of Pagadian any alcoholic liquor and/or beverages after 10:00 o'clock in the evening.
SECTION 2. Any person or persons violating the provisions of this ordinance shall upon conviction be liable to a fine of not more than Twenty (P20.00) Pesos or an imprisonment of not more than Ten (10) days or both fine and imprisonment at the discretion of the court. In case the violation is committed by person or persons not duly licensed to sell alcoholic liquors in accordance with existing tariff ordinance, the penalty to be imposed shall be a fine of not more than Fifty (P50.00) Pesos or imprisonment of a term not exceeding Twenty-Five (25) days, or both fine and imprisonment at the discretion of the court. The liquor being sold, or whatever is left inside the bottle or bottles when it is being drunk by the buyer or buyers inside a store, carenderias, bar or restaurant shall, together with the empty bottles, if there are any containers, cups or glasses, be confiscated in favor of the government.
SECTION 3. Definition of Terms - In this Ordinance, unless the context indicates otherwise, the definition of the various words used herein shall be as follows:
a. "alcoholic liquor and/or beverages" - includes tuba, tuba mixed any kind of soft drinks, tuba mixed with eggs and chocolate or any kind of beverage, bee, basi, sinobug, or wine of any brand or any mixture thereof.
b. "person or persons" - as used herein means every person or persons operating a store, a carenderia, a bar or a restaurant.
c. "containers" - refer to any article where liquor can be placed or mixed.
SECTION 4. This ordinance shall take effect immediately upon its approval.
