ORDINANCE NO. 10


"AN ORDINANCE REQUIRING ALL FOOD AND/OR DRINK HANDLERS IN, AND OPERATORS OF EATERIES TO SUBMIT FOR FLUOROSCOPIC EXAMINATION AND PRESCRIBING PENALTIES FOR VIOLATION THEREOF"

	BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN, THAT:

	SECTION 1. Food and/or drink handlers means all waiters, waitresses, servers, cooks and their assistants, and managers and/or operators of eateries who help in serving food and drinks.

	SECTION 2. Eateries means restaurants, bakeries, cafeterias, hotels, boarding houses, tuba dealers or stores, or any place or establishment where food and/or drink is served to the public.

	SECTION 3.	 All  food and/or drink handlers in and operators of eateries shall submit for fluoroscopic examination once a year.

	SECTION 4. A certificate shall be issued by the examining physician or his duly authorized representatives stating thereat that the person is free from contagious disease or defects in the lungs, his health fitness to serve or handle food/drink for the public and the date when the examination was done.

	SECTION 5. 	The examining physician or his representative shall not issue the health certificate mentioned in Section 4, if the person examined is known, after said examination, to be sufficient from contagious disease or positive defect in the lungs.

	SECTION 6. The certificate mentioned in Section 4, together with a small photograph of the examinee shall be displayed in a conspicuous place in the establishment.

	SECTION 7. Operators or proprietors of eateries must prohibit persons below Twelve (12) years old to serve or assist in handling foods and/or drinks.

	SECTION 8.  Any person convicted for violation of this ordinance shall be punished by a fine of not more than Fifty (P50.00) Pesos or not less than Twenty-Five  (P25.00) Pesos and the cancellation of the license granted to the proprietor or operator of the establishment

	SECTION 9. This ordinance shall take effect on the first day of August 1960.
