ORDINANCE NO. 10




















AN ORDINANCE REVISING RULES AND REGULATIONS GOVERNING CONSTURCTION AND REPAIR OF HOUSES AND BUILDINGS WITHIN THE MUNICIPALITY OF PAGADIAN.





BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT


      Section 1.- It shall be unlawful for any person or persons of corporation to construct and repair a house or building within the municipality of Pagadian without first securing a permit hereof issued by the Municipal Mayor and without paying the necessary permit fees to the Municipal Treasurer.


















      Section 2.- All applications for building permits shall be accompanied by a plan or sketch showing all the information required in Section, hereof. For buildings costing P10,000.00 or more and all building for public use, the plans to be submitted shall be prepared and signed by a duly licensed civil engineer or architect showing thereon the number, date and place of issue of his Privilege Tax Receipt.  But sketch or plan of any building that may cost below P10,000.00 may be prepared by a competent carpenter or contractor with experience in building construction of strong materials of cement, board, galvanize iron, etc; approved by the District Engineer or his authorized representative. Buildings of light materials of nipa bamboo and woods, of round materials does not necessarily need a detailed and complete plans as required in building of strong materials.


      Section 3.- The distance (a) from the center of the Municipal street to the building line shall be not less than ten (10) meters; (b) from the proposed building line to any existing building line shall be not less than (2) meters, unless fire wall is provided; and (c) from the proposed building line to the limits of the lots shall be not less than one and a half (1/2) meters, unless a fire wall is likewise provided.


      Section 4.- The house or buildings within any lot shall not occupy more than ninety (90) percent of the area of the lot, that is, there shall be left an open space of at least ten (10) percent of the lot.


      Section 5.- The site and surroundings of the proposed houses or buildings shall be sanitary and well provided with drainage and toilet facilities.


      Section 6.- The sketch or plan occupying all applications for building permits shall show the following: (1) dimensions of the structures; (2) kinds of materials to be used; (3) probable cost; (4) distances from the boundary of the lot; and (5) number of tax declaration and number of the land tax receipt for current year.





















      Section 7.- It shall be unlawful for any person or persons or corporation to make repair in any house or building without first securing a permit from the Municipal Mayor and without first paying the corresponding fees to the Municipal Treasurer.


      No permit shall be issued for the repair of any houses or building constructed not in conformity with this ordinance.


      Section 8.-  In the port area along-side the causeway the houses or buildings shall follow a regular alignment a foot bridges between the houses and the causeway shall be of the same height as the concrete curb thereon, provided that in constructing said foot bridges, no post shall be erected on or to close to the rock riprapping to the causeway.


      Section 9.- Any person or persons violating the provisions of this ordinance shall, upon conviction be punished by the court:


       1) by a fine of not more than fifty pesos (P50.00) or by imprisonment of not more than (50) days, or both fine and imprisonment in the discretion of the court.


      Section 10.- All previous building ordinances are hereby repealed.


      Section 11.- This ordinance shall take effect upon its approval.
