ORDINANCE NO. 1
AN ORDINANCE AMENDING SECTION ONE OF ORDINANCE NUMBERED ONE HUNDRED FIFTY ONE SECTION FIVE OF ORDINANCE NUMBERED ONE HUNDRED EIGHTY SEVEN, PROVIDING PENALTY FOR THE VIOLATION THEREOF.
BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT
Section 1. That Section One of Ordinance Numbered One Hundred Fifty Nine which reads:
"It shall be unlawful for any TPU and/or passenger buses to go around the town to solicit passenger" shall be read as follows:
Section 2. It shall be unlawful for the TPU and passenger buses to go around the town to solicit passenger. However, TPU and passenger by sea shall be allowed to go any place or point in the town limit except the wharf area, to pick up passengers with cargoes who has already a previous agreement or contract with the TPU and passenger buses operators;
That Section Five of Ordinance Numbered Eighty Seven which reads:
"It shall be unlawful for vehicles to go around the poblacion limit to solicit passenger after loading their respective passengers and park in the designated parking place of the ordinance. However, they can pick up cargoes with passenger upon request of the latter with permission from either the Chief of Police or from the Traffic Guard, shall be read:
Section 3. It shall be unlawful for vehicles to go around the poblacion to solicit passenger after loading their respective passengers and park in the designated parking place of this Ordinance. However, they can go to any point within the poblacion limit to pick up passengers with cargoes, who has already a previous agreement and contract with the TPU and passenger buses operators except within the wharf area which shall be strictly under this ordinance.
Section 4. That no person or persons having no professional driver license shall be allowed to drive TPU and/or passenger buses to pick up passenger within the poblacion limit of Pagadian.
Section 5. That any person or persons found violating the provisions of this ordinance shall upon conviction, be punished by a fine of not less than Ten Pesos (P10.00) but not more than Sixty Pesos (P60.00) or by imprisonment of not less than Ten (10) days but nor more than One (1) month, or both fine and imprisonment in the discretion of the court.
Section 6. That any ordinance or ordinance whose provisions in part or in full, contrary to and in conflict with the provisions of this ordinance shall be hereby repealed.
Section 7. That this ordinance, to be known as Ordinance No. 1, shall take effect upon its approval.
