ORDINANCE NO. 2
AN ORDINANCE AMENDING PARAGRAPH FIVE OF SECTION EIGHT OF ORDINANCE NUMBERED ONE HUNDRED SEVENTY THREE, OTHERWISE KNOWN AS MARKET ORDINANCE OF THIS MUNICIPALITY, PRESCRIBING THE RATE OF RENTAL OF STALLS AND/OR STORES WHOSE RATE HAVE BEEN FIXED BY SECTION FIFTY THREE, PARAGRAPH (F) OF ORDINANCE NUNBERED THIRTEEN, SERIES OF NINETEEN HUNDRED FIFTY SIX AND F THE TWO-STOREY BOOTH OR STORE ALONG THE MABINI STREET ONLY, AND IMPOSING PENALTY FOR THE VIOLATION THEREOF.
BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT
SECTION 1. That paragraph five of Section eight of Ordinance numbered one hundred seventy three, otherwise known as Market Ordinance of this Municipality which reads:
Section 8. Paragraph 5.- "That the leasee shall not live or sleep at night and cook his food or anything, nor authorize anybody to lie and sleep therein." shall be amended to read as follows:
` Section 8. Paragraph. That the leasee of booth o store and of a two-storey booth or store along the national highway and the mabini street who have already stayed in their respective booth or store, shall be allowed to stay and live therein provided, however, the leasee of such single and two-storey booth or store shall pay the corresponding rental fee therefore, fixed and prescribed in Section 2 of this ordinance;
SECTION 2. That the rate of rental of a single storey booth or store along the Mabini Street and the National Highway and of a two-storey booth or store along the Mabini Street only, hall be hereby fixed as follows:
a- For a single storey booth or store, there shall be collected a monthly rental of P20.00; and
b- For a second storey booth or store along the Mabini Street only, there shall be collected a monthly rental of P22.50 per door.
SECTION 3. That any owner and/or storekeeper of booth or store along the national highway the Mabini Street found violating the provisions of this ordinance shall, upon conviction be punished by a fine of not less than Fifteen Pesos (P15.00) but not more than Thirty Pesos (P30.00), or by imprisonment of not less than fifteen (15) days but not more than thirty (30) days, or both fine and imprisonment in the discretion of the court.
SECTION 4. That any ordinance or ordinances whose provisions in part or in full contrary to and in conflict with the provisions of this ordinance shall be hereby repealed;
SECTION 5. That this ordinance, to be known as Ordinance No. 2, series of 1957, of this municipality, shall take effect upon its approval.
