ORDINANCE NO. 14
AN ORDINANCE AMENDING SECTION THREE OF ORDINANCE NUMBERED FOUR IMPOSING PENALTY FOR THE VIOLATION THEREOF.
BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT
Section 1. Drunkeness. It shall be unlawful for any person within the municipal jurisdiction of the municipality of Pagadian, to get drunk with spirituous alcoholic or fermented beverage on a street or in any other public place.
The mere drinking of any beverage of the kind above described on public street or any public places, or in any establishment open to the public, where the drinking of spirituous, alcoholic or fermented beverage, is not legally permitted, shall be considered as an infraction of this ordinance.
The owner or the person actually in charge on any establishment open to the public where drinking of any of the beverage above described is not legally permitted. Allowing any person or persons to drink herein any of said beverage, shall be considered a violator of this ordinance.
Section 2. State of drunkenness on a public street or in any public place. It is hereby declared prohibited for any person to be present or to go about a public place or any place or any establishment open to the public, in the municipality of Pagadian, in a state of drunkenness cause by any spirituous alcoholic or beverage, contrary to sound conduct and public morality, such a state of drunkenness any be determined by the words, language, expressions or act of the person found under the influence of spirituous, alcoholic or fermented beverage, in relation to sound conduct, good behavior and public morality.
It also declared prohibited for any person found under the influence of any intoxicating beverage, to lie or any establishment open to the public, in this municipality of Pagadian.
Section 3. Section three of ordinance numbered four as amended eighteen which reads:
"Any person violating any of the provisions of this ordinance, shall be punished, upon conviction, by a fine of not less than Five (P5.00) Pesos, nor more than Fifty Pesos (P50.00), or by imprisonment of not exceeding two (2) months or both fine and imprisonment in the discretion of the court." Shall be read as follows:
Section 3. Penalty. Any person or persons violating any of the provisions of this ordinance shall upon conviction, be punished by a fine of not less than Twenty Pesos (P20.00), but not more than Sixty Pesos (P60.00), or by imprisonment of not less than Ten (10) days but not more One (1) month, or both, fine and imprisonment, in the discretion of the court.
Section 4. Repeal. Any ordinance or part of an ordinance whose provisions are contrary to and conflict with the provisions of the present ordinance, is hereby repealed.
Section 5. Effectivity. This ordinance to be known as Ordinance No. 14, shall take effect upon its approval.
