ORDINANCE NO. 1

















AN ORDINANCE REQUIRING TARTANILLA OWNER/OR OPERATOR TO HAVE THEREIN TARTANILLA NUMBERED, PRESCRIBING RATE OF FARE AND REGULATION AND IMPOSING PENALTY FOR THE VIOLATION THEREOF.





BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT

      Section 1. That the owner and/or operator of Tartanilla in this municipality, shall be required to number their tartanillas in this municipality.











	Section 2. That the rate of fare per passenger of tartanilla is hereby fixed at ten centavos (P0.10) within the Poblacion limit of Pagadian regardless of distance and location of his or her places of distinction.


	Section 3. That it shall be unlawful for the Cochero to refuse a paying passenger within the Poblacion limit of Pagadian by reason of distance or location of destination; that no person below the age of eighteen (18) years shall be allowed to be employed as Cochero; that no Cocheros shall be required to submit for examination, horse or horses to the Provincial Veterinarian for certification as to the physical fitness of horses; that it shall be unlawful for the Cochero to accept more than four (4) passengers per trip and that no tartanillas shall be allowed to run without having it provided with waste receptacle, a broom, shovel and with at least two (2) lights when operating during the period from 6:00 p.m. to  6:00 a.m.


	Section 4. Any7 cochero or cocheros found violating the provisions of this ordinance shall upon conviction, be punished by a fine of not less than Ten Pesos (P10.00), but nor more than thirty Pesos (P30.00), or by imprisonment of not less than Five (5) days nor more than Fifteen (15) days, or both fine and imprisonment in the discretion of the court.

	Section 5. Any existing Ordinance or Ordinance whose provisions are contrary to, ad in conflict with the provisions of this ordinance, shall be hereby repealed.

	Section 6. That this Ordinance, to be known as Ordinance No. 1, shall take effect upon its approval.
