ORDINANCE NO. 181

















AN ORDINANCE REQUIRING ALL STALLHOLDERS AND MARKET VENDORS IN THE PUBLIC MARKET OF PAGADIAN TO MAINTAIN CLEANLINESS AND GOOD SANITARY CONDITION WITHIN THEIR RESAPECTIVE PREMISES, AND PRESCRIBING PENALTIES FOR THE VIOLATION THEREOF.





BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT

      Section 1. All stallholders and market vendors in the public market of this municipality are herein required to keep and maintain cleanliness and good sanitary condition within their respective premises, and to provide a garbage can or any other receptacle that can adequately be used to keep refused and wastes.










      Section 2. The limit or boundary between two stall belonging to different owners shall include the front part of their stall up to an including two meters distance, the area within their stall the back part up to the including one meter distance from the stall and these area shall be considered in determining their stalls and their responsibilities herein set forth.











	Section 3. It shall be unlawful for any stallholder and market vendor to prevent or prohibit any herein officer from entering and inspecting their respective places in the performance of his official duties.


	Section 4. When any stall or stalls or place in the market used for selling is unclean or found not to be in good sanitary condition or there is no garbage can or receptacle for refuse or claimant, as the case may be, of the same verbally or in writing and the said notification shall clearly state the specific things to be done by the stallholder and/or public vendor concerned and the reasonable period within which they should be accomplished.  Failure of the latter's part to comply with the sanitary order or requirement within the period specified in the notification, the Municipal Health Officer or his duly authorized representative shall forthwith revoke the sanitary permit granted and order the closing of the said store.  Furthermore, the offender shall be liable to prosecution before the court of competent jurisdiction by the health authority concerned.


	Section 5. Any person violating the provisions of this ordinance, shall, upon conviction, pay a fine of not less than (P5.00) Pesos or suffer an imprisonment for not less than Two (2) days, or both, fine and imprisonment in the discretion of the court.

















	Section 6. Any ordinance, or parts of an ordinance, whose provisions are contrary to, and in conflict with the provisions of this ordinance shall be hereby repealed.

	Section 7. This ordinance, to be known as Ordinance No. 181, shall take effect upon its approval.
