ORDINANCE NO. 167
AN ORDINANCE GOVERNING FOR THE SANITARY MAINTENANCE IN PUBLIC MARKET AND SLAUGHTERHOUSE.
BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT:
Section 1. No market or slaughterhouse shall be built except in conformity with plans and specifications approved by the Director of Health or his duly authorized representative and no plan shall be approved for any market having ground surface of less than five hundred square meters (500) and no slaughterhouse shall be approved having a ground area of less than twenty square meters (20 sq. m.) and such structure shall have a floor made of good cement concrete of and thickness of not less than ten centimeters (10 cms) properly constructed and provided with adequate drains and filtering basins or with other drainage facilities, satisfactory to the Director of Health or his duly authorized representative. In addition there shall be a provision for an ample supply of water both hot and cold and suitable appliances for handling and taking care of the market products in sanitary manner.
Section 2. No partitions, shades or refer shall authorized or allowed inside of the market or slaughterhouse which any fire place or living quarters or other buildings or structures not forming a part of such buildings specified in the plans duly approved by the Director of Health or his authorized representative.
Section 3. It shall be the duty of the municipality to keep the
market and slaughterhouse and all appurtenance and part pertaining thereto in a cleanly and sanitary condition by at least two (2) daily cleansings; one before 5 A.M. and the other after the class of business of the day.
Section 4. All animals to be slaughtered for public consumption shall be taken to the slaughterhouse at an hour designated by the examining officer who shall be the representative of the Bureau of Health or a Veterinarian authorized to perform this service by the Director of Animal Husbandry, and when such animals had been examined they shall be properly tagged and keep at the slaughterhouse until killed and such killing shall be done in a human manner and shall take place at least two hours before the meat is offered for sale. All meat shall be cured, transported, or otherwise handled in a sanitary manner approved by the District Health Officer or his authorized representative.
Section 5. It shall be unlawful to kill for food any pig or calf less than five weeks old, or any kid less than eight weeks old or any dog.
Except in cases where special permit or authority to sell at other place than public market has been granted by the District Health Officer or his authorized representative, all foods of an animal in nature, fish, crabs, sea-foods and all vegetables foods that decay easily or any readily becomes contaminated shall be offer for sale unprotected from dust, flies or other vermin.
Section 6. It shall be unlawful fee any person to sell or offer for sale in the public market or elsewhere and foodstuffs or food product that may be in decomposing or decayed state or to sell or offer for sale any article of food the sale of which has been forbidden by any health officer (in compliance with the Administrative Order, Circular and Memorandum of the Director of Health promulgated from time to time) as a means of preventing the spread of any communicable disease or for other reason connected with the protection of the Public Health and the preservation of public good, and any decomposing or decayed or prohibited food sold or offered for sale shall be confiscated and destroyed by the Health Officer or his representative and no composition shall be allowed or paid the refer. Likewise, foods that are kept in a filthy or unsanitary condition may be seized or destroyed under the aforesaid condition.
Section 7. The District Health Officer may condemn and in case of such condemnation the Municipal Council shall cause to be destroyed or otherwise disposed of any slaughterhouse that in so great un sanitary state or situation as to practical remedial measure. In case of such destruction or disposal it shall be the duty of the Municipal Council to provide as early as practicable a suitable sanitary structure to take the place of one destroy or discarded.
Section 8. No lease, occupant or any employee of any market, store or other place where foodstuffs and food products are sold or offered for sale shall permit any human being or any animals of any description to occupy lie upon or have access of any table, shelf or other place foodstuffs are kept, displayed or stored.
Section 9. It shall be the duty of all persons operating, selling or offering for sale fruit and other foodstuffs to provide a suitable approved garbage can made of metal with tight fitting cover as a receptacle for garbage and rubbish.
Section 10. It shall be unlawful to turn loose or allowed to feed or pasture within the compound of market premises and slaughterhouse any animal such as: carabao, goat, sheep. pig, dog, cat, etc., which may constitute a nuisance or may impair the sanitary condition of the place.
Section 11. The public market and its premises is considered as public domain such it is unlawful to erect a private house intended for habitual residence or construction in which may constitute a public nuisance.
Section 12. Any person or persons violating or assisting in the violation of any part or part of this ordinance shall, upon conviction be fixed not less than Ten (P10.00) Pesos, or imprisonment for more than Three (3) months or both, such fine and imprisonment at the discretion of the court, and each day's continuance of the condition shall constitute a separate and distinct offense.
Section 13. This Ordinance shall take effect 15 days after the date of its passage, and ordinance or parts of ordinances in conflict with the provisions of this ordinance shall be void ad of no effect.
