AN ORDINANCE CLASSIFYING BAKERIES, PROMULGATING RULES AND REGULATIONS FOR THE ESTABLISHMENT AND OPERATION OF THE SAME, AND FOR OTHER PURPOSES.





BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT:


















      By authority of Section 2625 (d) and (jj) of the Revised Administrative Code, be it ordained by the Municipal Council of Pagadian, that:


      Section 1. DEFINITION OF TERMS:  For the purpose of this ordinance the term "bakery" as used herein shall be construed to mean all establishments that prepare and bake bread, cookies, pastries, sweets and similar products which are offered for sale to the public at wholesale or retail.








      Section 2. SANITARY PERMITM, REQUIRED: It shall be unlawful for any person, entity or corporation to establish, maintain and operate any bakery within the limits of the Municipality of Pagadian, Province of Zamboanga del Sur, without first securing a sanitary permit from the District Health Officer, or from his duly deputized local representative, and corresponding municipal license from the Municipal Treasurer of Pagadian.



	Section 3. CLASSIFICATION:  Bakeries shall be classified as First, Second, Third and Fourth Classes, as follows:

      a) FIRST CLASS - One that utilizes or bakes not less than eleven 50-pound sacks of flour per day;
      b) SECOND CLASS - One that utilize or bakes not less than six but not more than Ten 50-pound sacks of flour per day;
      c) THIRD CLASS - One that utilize or bakes not less than five but not more than 50-pound sacks of per day;
      d) FOURTH CLASS - One that utilizes or bakes less than two 50-pound sacks of flour per day.

	Section 4. LISENCE TAX:  The license tax for the operation of bakeries shall be imposed and collected in the manner and in accordance with the prescribed rates:

		First class bakery, ......................................... P150.00 per annum
		Second class bakery, ....................................   100.00 per annum
		Third class bakery, .......................................     60.00 per annum
		Fourth class bakery, ....................................      40.00 per annum














      Section 5. SANITARY REQUIREMENTS:  For the purpose of obtaining the required sanitary permit to operate a bakery, the following sanitary requirements shall be complied with:


	Section 6. PERSONNEL: Before being allowed to work in the establishment, every person engage in the preparation of distribution of bakery products should be armed with a health certificate issued free of charge by the District Health Officer or his duly deputized representative, which health certificate shall be renewable every six months.  Likewise, all workers should observe strict personal cleanliness, especially of their hands, finger nails and clothing.  They shall not smoke or chew tobacco during the process of making bread, nor shall they spit on the floor, wall or any part of the establishment except in the cuspidor previously provided for that purpose.

	Section 7. PROHIBITION AND REQUIREMENTS:  All ingredients and materials used in the preparation of bakery products for public consumption shall be of good and wholesome quality, free from adulteration and prohibited dilution.  Saccharine for sweetening purposes, yellow or any color to stimulate the presence of eggs, or any other color whereby damage or inferiority is concelled is not be used in the preparation of bakery products. The use of permissible food color other than yellow in bread and paste may be permitted, PROVIDED, however, that such coloring matter shall not be used in the manner whereby damage and inferiority are concelled; PROVIDED, further, that bakery products are prepared and made are solid in clean packages or sealed wrappers properly labeled (among other necessary phrase) ARTIFICIALLY COLORED in bold letters so that the phrase shall appear conspicuous in the wrapper.  When the colored appearance of any bread or alimentary paste in caused by the used of artificially colored butter margarine, or any substance other than eggs, or if the ingredients that caused the colored appearance of any bread of alimentary paste is caused by the use of artificially colored butter or margarine, or any substance other than egg, or if the ingredients that caused the colored appearance are partly egg and partly food color other than yellow or egg yellow, such bread or alimentary pastes shall likewise be disposed and sold in the manner afore-mentioned.  All bread, pastry and other bakery products shall be kept in dry, airy and properly screened rooms, place in appropriate sanitary shelves and cabinets protected from all kinds of insects and vermin.

	Section 8. BAKERY PRODUCTS: Bread, pastry and other bakery products for public consumption shall conform to the definitions and stands prescribed under the Pure Food Law.  They shall be displayed in fly glass counters, shelves or show causes which shall be  raised at least thirty centimeters from the payment.  They shall not be handled except with pincers, transported always in a sanitary manner, and delivered to the public properly wrapped in white, clean and not previously used wrapper or bag.

	Section 9. SLEEPING QUARTERS:  Under no circumstances shall a room or rooms utilized for the preparation and manufacture of bakery products and storage thereof be used for sleeping quarters; nor shall domestic and per animals be kept in any place of bakery establishment.






	Section 10. SANITARY MAINTENANCE:  It shall be the duty of the owner, manager or person in charge of a bakery establishment including its equipments and accessories used therein, and to see to it that all provisions of this ordinance are fully complied with.

	Section 11. PENAL PROVISO:  Any person, entity or corporation who violates the provisions of this ordinance or any part thereof, shall be punished once convicted in a court of competent jurisdiction by an imprisonment of not more than sic (6) months or a fine of not more than Two Hundred (P200.00) Pesos, or both fine and imprisonment, in the discretion of the court.

	Section 12. ORDINANCE OR PARTS THEREOF, REPEALED:  Ordinance or parts thereof which are inconsistent herewith are hereby repealed.

	Section 13. IN EFFECT, WHEN:  This ordinance shall take effect upon its approval.
