ORDINANCE NO. 148
AN ORDINANCE PRESCRIBING REQUIREMENTS AND FIXING FEE FOR PERMIT OF CINEMA OR MOVIE BUILDING WITHIN THE POBLIACION OF PAGADIAN.
BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT:
Section 1. It is hereby required that, for the safety and health of movie going public, before a cinematograph theaters building can be constructed within the Poblacion of this municipality, the interested party must first secure a building permit from the Municipal Mayor, after presenting to his satisfaction, compliance with the following requisites;
Section 2. It shall be the duty of the owner, manager or administrator of the cinematograph, theatrical shows, or similar place of amusement to have the seats, pavements and toilets cleaned once a day to have the same disinfected once an week.
Section 3. All buildings intended for cinematograph, theatrical shows, or similar place of amusement shall be used as such only and not as cockpit.
Section 4. The loudspeaker , being a public nuisance shall not be placed outside of the cinematograph or theater building after 9:00 P.M. for propaganda.
Section 5. All existing cinematograph or theatrical building which do not conform with any or all provisions of this ordinance are hereby required, within ninety (90) days after the date of effectivity hereof, to recondition and remodel their building in strict of conformity hereof, or shall be demolished.
Section 6. The interest party is required to pay building permit fee of Ten Pesos (P10.00) unto the Treasury of the Municipality before the Mayor shall issue the permit.
Section 7. Any construction not in accordance with the provisions of this ordinance shall cause the cancellation of the permit and the interested party shall be fined in the amount of (P50.00).
Section 8. Any person, owner, manager or in charge of cinematograph, theaters or similar place of amusements found violating the provisions of this ordinance shall upon conviction, be punished by a fine of not more than Two Hundred Pesos (P200.00) and by subsidiary imprisonment of not more than Six Months in case of insolvency, PROVIDED, that the rate to (P1.50) for each day of confinement. The Municipal Mayor, any at his discretion, cancel the permit after conviction, it depends upon the gravity of the offense.
Section 9. This ordinance shall take effect upon its approval.
