ORDINANCE NO. 13
AN ORDINANCE PRESCRIBING REGULATION GOVERNING THE BERHING OF VESSELS AND THE USE O THE WHARF OF THE MUNICIPALITY OF PAGADIAN, PROVINCE OF ZAMBOANGA.
BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT:
Pursuant to the authority contained in Section 1154 of the Administrative Code of 1917, and by virtue of Executive Order No. 72 issued by the President of the Philippines on December 3, 1936, be it ordained by the Municipal Council of Pagadian that:
SECTION 1. With the consent of the Secretary of Public Works and Communications previously had, the District Engineer, Bureau of Public Works, Zamboanga, is hereby designated berthing master at the wharf of Pagadian, Zamboanga, whose duty shall be to assign vessels to berth alongside the wharf of said port and to anchorages in the stream within the Pagadian Harbor.
SECTION 2. Vessels must be berth alongside the wharf systematically in the order to their arrivals and as near to each other as possible, in order to economize space; Provided that preference for berthing, space at the wharf shall be given, if possible to vessels having regular docking schedules.
SECTION 3. Launches, small motorboats, sailboats or other light watercraft shall stay at or near the side of the wharf within such time as to enable them to load or unload their passengers or cargoes only for not more than three hours, unless no inter island vessels desire to dock thereat. They shall keep clear of the berthing space in time to permit any incoming vessel to dock without the least delay or inconvenience to the latter.
SECTION 4. Throwing of garbage and waste matters of any kind overboard at the anchorage of vessels at the wharf or in the stream is hereby prohibited.
SECTION 5. No vessels with explosives, inflammable liquids, or other dangerous cargo aboard shall be allowed to lie alongside the wharf without permission from the berthing master, and then only for immediate discharge and removal of such cargoes. Soldering of this, containing petroleum and other inflammable liquids on the wharf is forbidden.
SECTION 6. The loading or discharging of explosives and inflammable cargoes shall, be made only between sunset and sunrise and with the express permission issued by the berthing master.
SECTION 7. Vessels desiring to load inflammable cargo while lying alongside the wharf must first complete loading general cargo after which they may be permitted to load their inflammable cargo.
SECTION 8. No vessel carrying explosive or inflammable cargo shall be permitted to be alongside the wharf and no vessel shall take berth thereat taking or discharging cargo.
SECTION 9. All damages to the wharf caused by any vessel shall be charge said vessel. The cost of the repairs must be paid by the agent thereof.
SECTION 10. Vessels lying alongside the Wharf shall be required to do a reasonable amount of work each day and shall pull out from the Wharf immediately after finishing the work of discharging or loading cargo. The berthing master shall be the judge of what constitute a reasonable amount of work each day.
SECTION 11. Cargo and other merchandise shall be remove from the wharf within 12 hours after discharging from vessels, and no accumulation thereof will be allowed; Provided, however, that is exceptional cases or in the case of heavy cargo the berthing master may, upon application, give special permission for goods to remain on the Wharf for a longer period but not exceeding 24 hours.
SECTION 12. Cargo discharge from vessels at the wharf shall be loaded unto carts or trucks, ad shall not be piled up on the wharf, nor shall trucks or vehicles move in such a way as to prevent free passage on the wharf.
SECTION 13. All goods and merchandise remaining on the wharf which have not been removed upon the expiration of 12 hours after discharge, or which remain after the period fixed in the special permit authorized by section 11 hereof, shall be taken charge of by the berthing master and stored, all expenses to be charged against the goods and paid by the owner or owners thereof, including wages of watchmen employed, without subjecting the said berthing master to responsibilities arising from any damage accidentally caused due to such removal.
SECTION 14. Steam vessels and motor boats that embark or debark passengers at wharf shall have gangs way, for the safety and convenience of passengers, of not less than 2-1/2 feet in width, with bottoms nailed across not more than 18 inches apart.
SECTION 15. Gangs way shall be provided at the expense of the owners or agents of vessels and they shall have strong adjustable guard rails or lines, and shall be of sufficient strength to withstand any weight that may be placed thereon.
SECTION 16. Master of vessels shall provide a bright light at the head of these gangplanks between the hour of sunset ad sunrise; said gangplanks to be used exclusively for the convenience of passengers and not for the discharge of any cargo or animals.
SECTION 17. All vessels carrying cattle must be provided with canvass straps (estrobo) or sling to be used in hosting cattle abroad.
SECTION 18. Consignees of vessels lying alongside the wharf shall be required to have the part used by their vessels swept and put in a clean condition immediately after the departure of the vessels.
SECTION 19. When a foreign vessels berth at the wharf the master shall immediately after the lines have been secured to the wharf, cause rat-guards of sufficient size and proper construction to the place on all lines leading to the wharf so as to prevent any rat going a shore.
SECTION 20. No cargo shall be discharged from or received on board of a vessel at the wharf before suitable rat-guards have been placed on all lines leading from the vessel to the wharf.
SECTION 21. All foreign vessels docking at the wharf shall be fended off from the said wharf at a distance of at least three feet.
SECTION 22. All cargo chutes and gangways connecting the vessel with the wharf shall be removed at night as soon as the vessel has stopped work of discharging or receiving cargo and shall not put in place again until next morning.
SECTION 23. All vehicles soliciting passengers on the wharf upon arrival of a vessel shall remain on the side of the wharf away from the vessel, and shall nor approach unless called by some persons for hire. Vehicles arriving at ship's gangway with passengers shall move away immediately after discharging passengers so as not block the approaches to gangways.
SECTION 24. Nothing in the preceding regulations shall be construed to prevent the berthing master from causing the removal of any vessel berthed improperly alongside the wharf or occupying berth not assigned to her.
SECTION 25. The berthing master shall be the judge of disputes arising among masters of the vessels over the berths along the wharf or causeway which shall be occupied by their respective vessels.
SECTION 26. Sail vessels and other small watercrafts berthed alongside the wharf without the permission of the berthing master and left along by their owners shall be taken away from their berths at the expense of their owners; Provided, that small have always on board at least one person to attend to their movements at the wharf, causeway or harbor whenever required.
SECTION 27. For any violation of the provisions of this regulation the offender shall be amenable to the penalty prescribed by Section 2713 of the Administrative Code.
SECTION 28. Philippine Customs officials and the District Engineer of Zamboanga shall give due publicity to the terms of this ordinance.
SECTION 29. This ordinance shall take effect upon its approval.
