ORDINANCE NO. 115
AN ORDINANCE FIXING THE DISTANCE FROM ONE FISH CORAL TO ANOTHER, IN THE MUNICIPALITY OF PAGADIAN, PROVINCE OF ZAMBOANGA.
BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT:
SECTION 1. The distance from the fish coral to another, in the sea whether "bonsod" or "paugmad" shall be less than one Hundred Fifty (150) lineal meters. Under this provision, it shall be unlawful for any person to set up a fish coral when any portion of which is less than 150 lineal meters from any portions of a neighboring one.
SECTION 2. The distance from one fish coral to another in any stream, lake or swamp, whether "bonsod" or "paugmad", shall be not less than Five (5) lineal meters. Under this provisions, it shall be unlawful for any person to set up a fish coral when any portion of which is less than fifty (50) lineal meters from any portion of a neighboring one.
SECTION 3. Any person found violating the provisions of this ordinance shall, upon conviction, pay a fine of not less than Ten (P10.00) pesos, nor more than Fifty (P50.00) Pesos, or suffer an imprisonment for not less than Five (5) days, nor more than Twenty Five (25) days, or both fine and imprisonment in the discretion of the court, and to remove at the owner's own expense within thirty (30) days from the date to the court's decision the fish coral set up or constructed in violation of this ordinance.
SECTION 4. Any ordinance or part of an ordinance which may be in conflict with the provision of this ordinance shall be hereby repealed.
SECTION 5. This ordinance shall take effect upon its approval.
