ORDINANCE NO. 109



AN ORDINANCE PROHIBITING ALL PERSONS, FIRM, OR CORPORATION TO LOOSEN THEIR ANIMALS OR LET THEM GO ASTRAY IN THE MUNICIPALITY OF PAGADIAN, PROVINCE OF ZAMBOANGA, AND FOR OTHER PURPOSES.



BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT:

      SECTION 1. It shall be unlawful for any person, firm or corporation to loosen their animals, like carabao, cattle, horses, pigs, goats and sheeps or let them go astray in the public places or private properties belonging to other persons in this municipality.


	SECTION 2. The Local Health Officer, or his duly authorized representative, in the Poblacion, and the Barrio Lieutenants in their respective barrios are hereby authorized to execute the provisions of this ordinance.



	SECTION 3. The Local Health Officer or his duly authorized representative may appoint one or more animal catchers to catch loose or astray animals (of the kinds mentioned in Section 1) in this Poblacion and to deliver them at once to the Municipal Treasurer for impounding purposes.


	SECTION 4. It shall be unlawful for any person to obstruct, prevent, or in any manner stop any animal catcher in the performance of his duty.

	SECTION 5. The animal catcher shall be paid by the Municipal Treasurer, or his duly authorized representative, upon delivery in the Municipal Treasury of the animal or animals caught by him in accordance with the following rates:

     a. For every head of carabao, cattle or horse ................ P1.50
     b. For every head of pig, goat or sheep .........................   1.00

      SECTION 6. Any person found violating the provisions of this ordinance shall, upon conviction, pay a fine of not less than Ten (10.00) Pesos, nor more than Fifty (P50.00) Pesos, or suffer imprisonment for not less than Ten (10) days nor more than Thirty (30) days, or both fine and imprisonment in the discretion of the court.

	SECTION 7. Any ordinance, or part of an ordinance, which may be in conflict with the provisions of this ordinance, shall be hereby repealed.

	SECTION 8. This ordinance shall take effect upon its approval.
