ORDINANCE NO. 108



AN ORDINANCE TO REGULATE THE STORING AND SALE OF GASOLINE, PETROLEUM, CRUDE OIL, OR ANY OTHER COMBUSTIBLE OF IMFLAMMABLE NATURE WITHIN THE MUNICIPALITY OF PAGADIAN, PROVINCE OF ZAMBOANGA.



BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT:

      SECTION 1. In order to minimize the danger of conflagration in this municipality, it is hereby prohibited for any person, firm or corporation.


       a) To keep or store gasoline in any place store, house or building, etc.) except in a warehouse of fireproof materials constructed at least five (5) meters from any house or building, and to keep or sell gasoline to the public, except in a gasoline station approved by the Assistant Civil Engineer and the Municipal Mayor; and


       b) To keep ion the store, house or building petroleum, crude oil, or any other combustible or inflammable nature more than Ten (10) cans of 5 gallon each.  Any quantity of petroleum, crude oil, or any other combustible or inflammable nature in excess of Ten (10) cans of Five (5) gallon each shall be kept or stored in a warehouse of fire proof materials constructed at least Five (5) meters from any house.




	SECTION 2. Any and all drums of any size of gasoline petroleum, crude oil, or any other combustible or inflammable nature shall be kept or stored in a warehouse described in the next preceding section.



	SECTION 3. Any quantity of gasoline, petroleum, crude oil, or any other combustible or inflammable nature kept or stored not in the place or in excess of the quantity fixed by this ordinance, shall be subject to confiscation by the Municipal Police.


	SECTION 4. It shall be unlawful for any person or persons to stop or in any manner prevent any Municipal Policeman from entering any store, house or building in this municipality for the purpose of checking up the number of cans or drums of gasoline, petroleum, crude oil, or any other combustible or inflammable nature that may be found there.

	SECTION 5. Any person found violating the provisions of this ordinance shall, upon conviction, be punished by a fine of not less than Fifty (P50.00) Pesos, nor more than Two Hundred (P200.00) Pesos, or imprisonment for not less than One (1) month, nor more than Six (6) months or both, fine and imprisonment, in the discretion of the court.





	SECTION 6. Any ordinance, or part of an ordinance, which is in conflict with this ordinance, shall be hereby repealed.

	SECTION 7. This ordinance shall take effect upon its approval.
