ORDINANCE NO. 107
AN ORDINANCE PROHIBITING THE CONSTRUCTION OF ANY BUILDING WITHIN A DISTANCE OF TWENTY FIVE METERS FROM ANY ESTABLISHED CEMETERY, AND/OR PERFORATION OF A WELL OR ANY OTHER SOURCE OF WATER SUPPLY WITHIN A DISTANCE OF FIFTY METERS THEREFROM.
BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT:
SECTION 1. It shall be unlawful to construct any building for dwelling, school or business purposes within a distance of Twenty-Five (25) meters from an established cemetery, or the perforation of a well or any source of water supply within a distance of Fifty (50) meters therefrom.
SECTION 2. Any building or source of water supply that may be hereafter be built, shall be removed by the owner within thirty (30) days after the decision of the court of competent jurisdiction.
SECTION 3. Any person or corporation violating this ordinance shall be punished by a fine of not less than Ten Pesos (?10.00), nor more than Two Hundred Pesos (P200.00), or by imprisonment of not less than Six (6) months or both at the discretion of the court. In the case of the corporation, the manager or the office who constructed or accepted the work will be punished.
SECTION 4. This ordinance shall take effect upon its approval.
