AN ORDINANCE PROVIDING FOR THE ADOPTION OF TOILETS AND LATRINES WITHIN THE JURISDICTION OF THIS MUNICIPALITY, IN ACCORDANCE WITH THE SCIENTIFIC EXIGENCIES.

ORDINANCE NO. 105







AN ORDINANCE PROVIDING FOR THE ADOPTION OF TOILETS AND LATRINES WITHIN THE JURISDICTION OF THIS MUNICIPALITY, IN ACCORDANCE WITH THE SCIENTIFIC EXIGENCIES.



BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT:


	SECTION 1. It shall be required of all persons who are heads of families to construct or build one or more toilets or latrines in their respective lots or premises, residence or place of business;





	SECTION 2. All toilets or latrines shall have a floor area of not less than one square meter and no system or privacy accommodation shall be permitted except the following:

		a- Antipolo System
		b- Septic Tank
		c- Bored-hole latrine
		d- Any other system approved by the director of health of his
		    authorized representatives.



	Provided that, the selection of any of the system above enumerated shall be subject to the exigencies of the ground site or either circumstances that each case may require;


	No toilet or latrines or similar privacy accommodation shall be constructed without adequate facilities of ventilation approved by the District Health Officer or his local representatives, nor shall such toilet or latrines have direct communication with the kitchen, dining or sleeping room of any house or dwelling, nor be in communication with any other part of such house except when toilet or latrine shall be provided with a tight-fitting door.


	SECTION 3. This municipality shall, as soon as funds are available, construct according to plan provided by the Director of Health of his duly authorized representatives, keep in repair and maintain in sanitary condition, such number of public convenience stations as may be required and to locate such station at such places in the Poblacion and barrios as may be designated by the District Health Officer or his local representatives;


	PROVIDED, That the additional number of public conveniences stations necessary for the accommodation of the temporary additional population during two fiestas or pilgrimages may be of such temporary character as may be approved by the District Health Officer or his local representatives;
















































	SECTION 4. No person shall defecate or urinate in any place other than in the appropriate receptacles, toilet or latrine, nor shall nay human excrement be deposited, or thrown in any place or other than the system stated in the preceding section 3 or in authorized pits;


	SECTION 5. All public closets, convenience stations and other places used as such shall be adequate lighted and ventilated and shall have separate compartments for each sex;


	SECTION 6. No person shall mark the wall of any closet or convenience station, by writing or drawing anything thereon, or by other means or manner disregarded the proper use of public properties;


	SECTION 7. All buildings or places in which people are engaged or employed in any trade or business, or any building or place used for the purpose or entertainment, and every building of a public character in which people are employed or assembled shall be provided with a sufficient number of toilet for each sex separated as may be ordered by the District Health Officer, or his local representatives or Municipal Officials;


	SECTION 8. No pit for the reception of human excrement shall be constructed with less than ten meters distance of any human habitation, and with a depth less than two meters. Such deposit shall be covered with a layer of clean earth, snad ashes or unslaked line in sufficient quantity that may prevent the escape of obnoxious odor and to prevent the breeding of flies, provided that in, when any pit becomes filled to fifty centimeters of the ground level is shall be condemned at once by filling at solidly with earth;


	SECTION 9. Facilities and duties of all Officials:


	(Section 10. 401, Penal Code):  All Municipal Officials of this Municipality shall be ex-officio Sanitary Inspectors, as such they are duty bound and obliged to see the observance and fulfillment of this ordinance, in their respective district, place and incumbencies.  For the best interpretation of this provisions, it must be born in mind that the Municipal Officials, for the purpose and intention of this ordinance, aid all Municipal Councilors, Barrio Lieutenants, Policemen and Teachers;


	SECTION 10. The Director of health or any Medical Officer, Sanitary Inspector, Municipal Officials or other persons acting under the authority of the Director of Health or his duly authorized representatives as contemplated by the provisions of this Ordinance, shall have authority to enter in an orderly manner any building or premises between the hours of 8:00 A.M. and 6:00 P.M. to see and observe the enforcement of this ordinance and no person shall, for the enforcement of this sanitary measures, restrict or bridged their functions;


	SECTION 11. Penalty: Any person who shall violate any provision of this requirements of this ordinance or any section thereof, in part or in whole, shall upon conviction by punished by a fine of not to exceed TWO HUNDRED (P200.00) PESOS or by imprisonment of not less than SIX (6) MONTHS or both, in the discretion of the court.

















	SECTION 12. Any ordinance in part or in whole, in conflict with the present, is hereby declared null and void;

	SECTION 13. This ordinance shall take effect upon its approval.
