Republic of the Philippines PROVINCE OF ZAMBOANGA DEL SUR P A G A D I A N ORDINANCE NO. 104 AN ORDINANCE PRESCRIBING RULES AND REGULATIONS FOR THE PHYSICAL EXAMINATION FOR WAITERS, WAITRESSES, HOSTESSES, ETC., IN THE EMPLOY OF ANY BAR, RESTAURANT, CARENDERIA, HOTELS, AND ANY OTHER ESTABLISHMENT, AND PRESCRIBING PENALTIES FOR THE VIOLATION THEREOF. BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT: SECTION 1. It shall be unlawful to employ as waiter, waitresses, hostess, cook and/or helper in any capacity, in any bar, restaurant, carenderias, tuba store, hotel, lodging house or and food establishment selling food and giving entertainment to the public any person less than 18 year of age, and who does not possess or has not obtained a medical certificate from the President Sanitary Division, or Municipal maternity and Charity Clinic Physician, attesting that she or he is free from any contagious and infectious disease; SECTION 2. A Permit fee of One Peso (P1.00) shall be paid to the Municipal Treasurer by the person concerned; SECTION 3. The person enumerated in section 1 hereof must submit a blood test once a year and to a medical examination once every three month before the Health Officer of this Municipality, or to any government Social Hygiene Hospital in the community, for the protection and security of the buying public in general, Evasion to comply herewith will be sufficient ground for the Municipal Health Officer to cancel a permit already granted; SECTION 4. All owners and proprietors of the establishments mentioned in section 1 hereof are required to submit a list of all persons in their employ as waiters, waitresses, cooks, hostesses, and/or helpers not later than fifteen days after the establishment of the said place and submit them for health examination as contemplated in the last paragraph 1 of section 1 hereof; SECTION 5. It shall be unlawful for any person employed in any category mentioned in section 1 to be found without a permit from the Municipal Health Officer; SECTION 6. It shall be unlawful for any person or proprietor to be found having in his employ any person afflicted with any contagious or infectious disease and having failed to submit said person to medical examination as required herein; SECTION 7. Any person who shall be found guilty of violation any or all portions hereof, shall upon conviction, be punished by a fine of not more than TWO HUNDRED (P200.00) PESOS, or imprisonment of not more than SIX (6) months, or both at the discretion of the court. SECTION 8. Any ordinance which are in conflict with the provisions hereof are hereby repealed. SECTION 9. This ordinance shall take effect upon its approval.
