ORDINANCE NO. 102



AN ORDINANCE REQUIRING FOR HYGENIC REASONS, THAT ANY LAND OR BUILDING WHICH IS IN AN INSANITARY CONDITION BE CLEANED AT THE EXPENSE OF THE OWNER OR TENANT THEREOF, AND UPON FAILURE TO COMPLY, TO HAVE THE WORK DONE BY THE MUNICIPALITY ASSESSING THE EXPENSES UPON THE LAND OR BUILDING AND FOR OTHER PURPOSES.



BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT:

	SECTION 1. The owner or tenant of any land or building is required to clean and to keep a sanitary condition all the time at his expense;



	SECTION 2. Upon failure of the owner or tenant to clean and keep in a sanitary condition his land or building, the Municipality may undertake the work on cleaning and the same thru laborers employed publicity, and assess the expense thereof upon the owner or tenant;



	SECTION 3. It shall be understood for purposes of this ordinance that the term "Building" shall include the public market, and that any persons occupying any fixed shall be covered by Section 1, of this ordinance;

	SECTION 4. All person occupying permanent stalls in the public market shall have tables, containers, boxes or receptacles, etc., for depositing their goods and accommodating their commodities provided, that such tables, boxes or receptacles, etc., shall not be less than 12 inches from the floor to facilitate cleaning the same, provided, further, that the display or merchandise and foodstuffs shall not in any way offer obstruction or inconvenience to the free movement of customers and the general public in the market;

	SECTION 5. It shall be the duty of every house owner and of any person residing in the Municipality to clean the street and canals fronting and immediately adjoining the house and/or place of residence;

	SECTION 6. Any person found violating the provisions of this ordinance shall be punished with a fine of not less than TWO HUNDRED (P200.00) PESOS, or imprisonment of not more than SIX (6) MONTHS or both, at the discretion of the court.

	SECTION 7. Any ordinance or ordinances in conflict with the foregoing provisions are hereby repealed.










	SECTION 8. This ordinance shall take effect upon its approval.
