ORDINANCE NO. 94


AN ORDINANCE REGULATING THE ISSUANCE OF LICENSES AND PERMITS AND TO PROVIDE LICENSE TAXES, AND CHARGES IN THE MUNICIPALITY OF PAGADIAN, PROVINCE OF ZAMBOANGA, AND PRESCRIBING PENALTIES THEREOF.


BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN THAT:

	SECTION 1. PERMITS AND LICENSES:  No person, firm or corporation shall be allowed to own, establish, maintain, operate and engage in any business or occupation without obtaining a permit from the Municipal Mayor or his duly authorized representative, in case where such permit is necessary, and without first having paid the necessary license taxes, fees and charges to the Municipal Treasurer as prescribed in this ordinance.


	SECTION 2. TIME FOR PAYMENT OF MUNICIPAL LICENSE TAXES:  With the exception of proprietors of theaters, museums, cinematograph, concert and circuses, who may be taxed by month, the occupant and vendors of any place or compartments in the public markets, who may pay their rents or fees either annually, monthly, or daily, or unless otherwise provided herein, all municipal license taxes shall be collected on the yearly basis, payable quarterly in advance within the First Ten (10) days of the quarter with 20% penalty for failure to pay any such tax, fees or charges during the time required.



	SECTION 3. SEPARATE LICENSE FOR DIFFERENT BUSINESS:  No person, firm or corporation shall be allowed to conduct more than one kind of business in a single establishment without paying the necessary license taxes or fees for such business as herein prescribed.

	SECTION 4. POSTING AND SURRENDER: All license shall be posted in a conspicuous place in the establishment while still in force and shall at all times be opened to inspection by any officer authorized by law to do so.  A license shall cease to be in force upon expiration of the term or upon revocation for cause. When a license desires to close his business or abandon his occupation, his license for same shall be surrendered to the Municipal Treasurer for notation and cancellation.

	SECTION 5. TAXES, FEES AND CHARGES: The municipal license taxes, fees and charges shall be collected in accordance with the following schedule of rates:

	SECTION 6. Any person found violating the provisions of this ordinance, shall, upon conviction, pay a fine of not more than Thirty Pesos (P30.00) or serve imprisonment for not more than (1) month, or both, fine and imprisonment in the discretion of this ordinance, are hereby repealed.

	SECTION 7. All existing tariff ordinances or portions thereof, whose provisions are inconsistent with the provisions of this ordinance, are hereby repealed.

	SECTION 8. This ordinance shall take effect upon its approval.
